1. Acceptance of Terms

These Terms of Service (“Terms”) are a binding agreement between you and RRKMART (“RRKMART”, “we”, “us” or “our”). By accessing rrkmart.com or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy and Returns & Refunds Policy, all of which are incorporated by reference.

If you do not agree with these Terms, you must not use this website or place an order.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. If you are placing an order on behalf of a minor, you confirm that you are the parent or legal guardian and that you accept these Terms on their behalf.

3. Product Information and Safety

We make every effort to display products accurately, including color, sizing, materials and certifications. Because screens vary, actual colors may differ slightly from what you see online.

All bicycle helmets we sell comply with the U.S. Consumer Product Safety Commission standard 16 CFR 1203. Helmets are designed to reduce the risk of head injury in many impacts, but no helmet can protect against all foreseeable impacts, including every type of crash.

• Read and follow the fit and care instructions supplied with your helmet, and check the fit before every ride.
• A helmet that has sustained a significant impact, or that shows cracks, crushed foam or a damaged strap, must be replaced even if the damage is not visible.
• You are responsible for selecting the correct size and for using the product for its intended purpose.

4. Orders and Order Acceptance

Your order is an offer to buy. A contract is formed only when we accept your order and send a shipping confirmation email. We may decline or cancel an order for reasons including product unavailability, pricing or description errors, suspected fraud, reselling activity, or shipping restrictions.

If we cancel an order after you have been charged, we will issue a full refund to the original payment method.

5. Pricing, Taxes and Payment

All prices are shown in U.S. dollars and exclude applicable taxes and shipping charges unless stated otherwise. Sales tax is calculated at checkout based on the shipping address.

If a product is listed at an incorrect price due to a typographical or system error, we may cancel the order and refund any amount paid, whether or not the order has been confirmed.

Payment is processed by our third-party payment providers at checkout. You confirm that the payment method you use is yours and that the information you provide is accurate.

6. Shipping and Risk of Loss

Shipping timeframes, rates and delivery options are described in our Shipping Policy. Delivery estimates are not guarantees and do not account for carrier delays, weather or customs processing.

Risk of loss passes to you when the order is handed to the carrier. Title passes on delivery. If a package is lost or arrives damaged, contact support@rrkmart.com and we will help file a claim with the carrier.

7. Returns and Refunds

Returns, exchanges and refunds are governed by our Returns & Refunds Policy, which describes the return window, item condition requirements and how refunds are issued.

8. Limited Warranty

We warrant that products are free from defects in materials and workmanship under normal use for 1 MONTHS from the date of delivery. If a product fails to meet this warranty, contact us and we will repair it, replace it or refund the purchase price at our option.

This warranty does not cover damage caused by a crash or impact, misuse or modification, normal wear and tear, exposure to extreme conditions, or use of the product in a manner inconsistent with its instructions.

9. Assumption of Risk and Limitation of Liability

Cycling, skating, scootering and similar activities involve inherent risks of serious injury or death that cannot be eliminated by protective equipment. To the fullest extent permitted by law, you assume these risks when you purchase and use our products.

To the fullest extent permitted by law, RRKMART will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising out of your use of the site or any product purchased from us. Our total liability for any claim relating to an order is limited to the amount you paid for the product giving rise to the claim.

Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the limitations above may not apply to you.

10. Indemnification

You agree to indemnify and hold RRKMART harmless from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the website, or your violation of any law or the rights of a third party.

11. Intellectual Property

The website design, text, images, logos, product photography and all other content are owned by RRKMART or its licensors and are protected by copyright and trademark law. You may not copy, reproduce, distribute, modify or create derivative works from this content without our written permission.

12. Prohibited Use

• Using the site for any unlawful purpose or to solicit unlawful acts.
• Attempting to gain unauthorized access to our systems or another user's account.
• Interfering with the operation or security of the site, including through scraping, automated queries or denial-of-service activity.
• Reselling or purchasing products in bulk for resale without our written consent.

13. Governing Law, Arbitration and Disputes

These Terms, and any dispute arising out of or relating to them or to any order you place, are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply to any sale made through this website.

Nothing in this section limits any mandatory consumer protection rights you have under the law of your state of residence. Where the law of your state of residence would otherwise apply to a particular claim and cannot be waived by agreement, that law governs that claim.

Before starting arbitration, please contact us at support@rrkmart.com with a description of the dispute and what you would like us to do. We will try to resolve the matter informally within 30 days. This step is a condition of arbitration except where prohibited by law.

Except for the carve-outs below, any unresolved dispute will be settled by final and binding arbitration administered by the International Centre for Dispute Resolution (ICDR), the international division of the American Arbitration Association, under its International Arbitration Rules in force when the claim is filed. The seat of arbitration is New York, New York, United States. The language of the arbitration is English, and the dispute will be decided by a single arbitrator. Where the applicable rules permit, the arbitration may be conducted by written submissions, by telephone or by video conference, so that you do not have to travel.

We will not seek to recover our attorneys' fees or arbitration costs from you in an individual consumer arbitration brought in good faith.

You and RRKMART agree that disputes will be brought only in an individual capacity, and not as part of any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding. If this limitation is found unenforceable as to a particular claim, that claim must proceed in a court of competent jurisdiction rather than in arbitration.

The arbitral award is final and may be entered and enforced in any court of competent jurisdiction, including under the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the New York Convention).

If any part of this section is found invalid or unenforceable, the remainder of this section and the rest of these Terms remain in full force and effect.

• Small claims: either of us may bring an individual claim in the small claims court of the state and county where you reside, if the claim qualifies for that court and remains there.
• Injunctive relief: either of us may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property or confidential information.
• Informal resolution: disputes should first be raised with support@rrkmart.com, as described above.

14. Changes to These Terms

We may update these Terms from time to time. The updated version takes effect when posted, and the “Last updated” date above shows the most recent revision. Continuing to use the site after a change means you accept the revised Terms.
